Terms of Service
1. Agreement to Terms
By using Rhythm ("the Service"), operated by Rhythm App, LLC, a Delaware limited liability company, you agree to these Terms of Service.
These terms may change over time. For substantial changes, I'll give you at least 30 days' notice by email (see Section 15).
2. Eligibility
You must be at least 18 years old to use Rhythm. If you're between 13 and 17, you can use Rhythm with a parent or guardian's permission and supervision.
Rhythm is for parents and caregivers to track information about children, not for use by children. I don't knowingly collect personal information from children under 13.
3. Your Account & Security
When you create an account, you're responsible for keeping your login credentials secure. Use a strong, unique password. If you think someone has accessed your account without permission, let me know immediately.
If you invite others to your household, you're vouching for them. Choose your household members carefully. They'll have access to your shared data.
4. Your Data
You own your data. The feeding times, sleep logs, and notes you enter belong to you. I don't sell it, mine it, or use it to train AI models.
I need a limited license to operate the service: storing your data, syncing it between your devices, and displaying it back to you. That's it. You can export all your data anytime in JSON format, no subscription required.
When you delete your account, your data is removed from all servers immediately. Encrypted backups age out within 90 days. See the Privacy Policy for details.
5. Subscription & Billing
Rhythm has a free tier that includes unlimited event logging and local storage. Premium features like household sync require a paid subscription.
I use Stripe to process payments. Your payment details go directly to Stripe. I never see or store your full card number.
Subscriptions renew automatically. You can cancel anytime from your account settings. When you cancel, you keep access until the end of your billing period.
6. Acceptable Use
Please don't:
- Use Rhythm to store or transmit illegal content
- Attempt to access other users' data without permission
- Reverse engineer, decompile, or disassemble the service
- Use automated systems (bots, scrapers) to access the service
- Interfere with the service's operation or other users' access
- Use Rhythm for any commercial purpose without my written consent
I reserve the right to suspend or terminate accounts that violate these rules.
7. Household Sharing
When you create a household and invite members, everyone shares access to the household's data. That's the point - coordinating care means sharing information.
Everyone in a household is responsible for what happens in it. If someone violates these terms, the whole household may be affected.
You can leave a household at any time. If you're the household owner, you can remove members or delete the household entirely.
8. Intellectual Property
Rhythm - the code, design, name, logo, all of it - belongs to Rhythm App, LLC. These terms don't grant you rights to my trademarks or branding. Don't copy, modify, or redistribute the service without my written permission.
9. Feedback
If you send me feature ideas or suggestions, I can use them freely. No obligation on either side - you don't have to send feedback, and I don't have to build it.
10. Disclaimers
Rhythm is not medical advice. It's a tracking tool, not a healthcare provider. Suggestions like wake windows or nap timing are based on patterns in your data, not medical expertise. Talk to your pediatrician about anything health-related.
The service is provided "as is" without warranties of any kind. I do my best to keep Rhythm running smoothly, but I can't guarantee it will be available 100% of the time or that predictions will be accurate.
Every baby is different. What the algorithm suggests may not work for your child. Trust your instincts. You know your baby better than any app.
11. Limitation of Liability
To the maximum extent permitted by law, Rhythm App, LLC's total liability is limited to the amount you've paid in the 12 months preceding any claim.
Rhythm App, LLC is not liable for indirect, incidental, or consequential damages, including lost data or decisions made based on the service's suggestions.
12. Indemnification
If your use of Rhythm or a violation of these terms leads to a claim against me, you agree to cover the resulting losses, including reasonable legal fees.
13. Termination
You can leave anytime. Delete your account from the settings page, and your data is removed immediately.
I can terminate or suspend your account if you violate these terms, engage in illegal activity, or abuse the service. I'll try to give you notice, but in cases of serious violations, I may act immediately.
14. Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware.
15. Changes to Terms
I'll update these terms as needed. For substantial changes, I'll email you at least 30 days' notice before they take effect.
If you disagree with updated terms, you can close your account before they take effect. Continuing to use Rhythm after changes go live means you accept the new terms.
16. General
If a court strikes any part of these terms, the rest still stands. Just because I don't enforce something once doesn't mean I've waived it. I can assign this agreement (for example, if I sell the business); you can't without my written consent. These terms and the Privacy Policy are the whole agreement between you and Rhythm App, LLC.
